Federal 50-Employee Count

Fewer than 50 full-time employees does not always settle the federal count.

Part-time and variable-hour employees can still affect the threshold. I will work from the workforce facts you already know and show whether those other hours can move the business to 50.

I'll start with your full-time count, then show you how much the other hours can add.

The federal count adds more than full-time employees.

Hours from part-time and variable-hour employees are added up and turned into full-time equivalents. That's how a business with fewer than 50 full-time people can still reach 50, and it's also why many of them don't.

  • You have fewer than 50 employees at 30 hours a week or more.
  • You also have part-time or variable-hour employees.
  • You're not sure how their hours are counted.

What I'll put together

Rough figures are enough to start.

Full-time pattern

The employees consistently at the full-time level.

Other employees

The number of other employees on payroll.

Their hours

The hours those other employees usually work.

You'll see whether the other hours can move the count

You will see whether the other workforce can change the direction, or whether the count stays below 50 even before a deeper payroll review.
