Federal 50-Employee Count

Getting close to 50 is when ordinary headcount starts becoming a bad shortcut.

The federal count is not just today's roster. I will use the workforce pattern you already know to show whether the 50 line is actually in play.

I'll work through last year's pattern first, then show you where the 50 line sits and what would settle it.

Today's roster is not the number the federal count uses.

The count looks back at the whole prior year, month by month. People at 30 hours a week or more count one each, and everyone else adds up through their hours. So a business near 50 can land on either side depending on how the year actually went.

  • Your headcount has been moving toward 50.
  • Some of your people work fewer than 30 hours a week.
  • Staffing changed through last year.

What I'll work through

You only need what you already know about last year's workforce.

The year

How the workforce changed through last year.

Full-time pattern

How many people were consistently at 30 hours a week or more.

Everyone else

Whether the rest of the workforce can materially change the count.

You'll see where the 50 line actually sits

You will see what your current facts can establish, what they cannot, and the first record I would check if the answer still depends on the details.
